Terms and Conditions for Chinatown Wishing Tree Online Campaign Lucky Draw

The following terms and conditions shall apply to the Chinatown Wishing Tree Online Campaign Lucky Draw.

1. Eligibility and Participating Period

1.1	The draw is open to all Eligible Contestants as definted in Clause 1.3.
1.2	The participating period for the Draw shall be from 01 January 2012 to 6 February 2012 (5 weeks, both dates inclusive) (“Promotion Period”).
1.3	“Eligible Contestants” refer to individuals who are in good standing with Kreta Ayer - Kim Seng Citizens Consultative Committee (as determined by Kreta Ayer – Kim Seng CCC in its sole discretion) and who meet the following criteria:

	a) Submitted completed and valid entries
	b) Is a Singapore citizen or Permanent Resident

1.4	a) Each Eligible Contestant shall be entitled to only one (1) chance in the Draw for each Participating week.
	b) All winners will not be eligible for any subsequent draws
	c) All non-winners will go into the pot for the subsequent week’s draw

1.5	Members of Kreta Ayer - Kim Seng CCC and their immediate family members shall not be eligible to participate in the Draw. In addition, employees of any partners and agencies (including, without limitation, any external auditor(s) and advertising agencies) who are directly involved in the organisation or conduct of the Draw as determined by Kreta Ayer - Kim Seng CCC, shall not be eligible to participate in the Draw.

2. Mechanics of the Lucky Draw

2.1	There shall be two (2) winners per week who shall be entitled to receive a prize.
2.2	The prizes for the Draw are – Two (2) units of iPad 2.
2.3	Kreta Ayer - Kim Seng CCC shall be entitled at its sole and absolute discretion (without any obligation to provide a reason) to forfeit the prize from any winner or disqualify any individual from the Draw.

3. Conduct of Draw

3.1	The Draw will be held on the Saturday of each week or such other date as Kreta Ayer - Kim Seng CCC may determine in its sole and absolute discretion.
3.2	The Draw shall be conducted at Kreta Ayer - Kim Seng CCC or at any other location to be determined by Kreta Ayer - Kim Seng CCC in its absolute discretion.
3.3	The winners of the Draw shall be determined on the day of the Draw. The winners will be selected at random by such means and methods (which may be manual or computerised) as Kreta Ayer - Kim Seng CCC may determine. Kreta Ayer – Kim Seng CCC shall draw reserve winner(s) in substitution of any winner who may subsequently be disqualified from the Draw.
3.4	If any prize remains unclaimed for two (2) months after the relevant date of the Draw, it will be forfeited (without any liability on the part of Kreta Ayer – Kim Seng CCC to any person) and it and/or the proceeds therefrom will be donated to a charitable organization to be decided at the sole and absolute discretion of Kreta Ayer – Kim Seng CCC. The prize winner whose prize has been forfeited is not entitled to any payment or compensation whatsoever from Kreta Ayer – Kim Seng CCC.
3.5	The winner shall be notified by email and telephone as provided by the participant to Kreta Ayer – Kim Seng CCC, within one (1) month from the date of the Draw (or at such other date(s) as may be determined by Kreta Ayer – Kim Seng CCC in its absolute discretion).

4. General

4.1	Each Draw winner consents to Kreta Ayer – Kim Seng CCC disclosing and/or publishing his/her name and his/her particulars in any manner which Kreta Ayer – Kim Seng CCC may deem fit for publicity purposes. Each winner agrees to co-operate with and participate in any advertising or publicity activities of Kreta Ayer – Kim Seng CCC relating to the Draw and agrees that Kreta Ayer – Kim Seng CCC may publicise the name and/or photograph of each winner in such mode and manner as Kreta Ayer – Kim Seng CCC considers fit.
4.2	All Draw winners expressly and irrevocably authorize and consent to Kreta Ayer – Kim Seng CCC to disclose their particulars to any party for the purpose of organizing, promoting and/or conducting the Draw.
4.3	Each Draw winner shall accept the Prize on an "as is" basis. Kreta Ayer – Kim Seng CCC gives no representation or warranty whatsoever as to the quality, merchantability or fitness for purpose or any other implied terms or conditions with respect to any prize. Notwithstanding anything herein, Kreta Ayer – Kim Seng CCC shall not at any time be responsible or held liable for any defect or malfunction in any prize, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of any prize by any person. All prizes are neither transferable nor exchangeable for cash, credits or otherwise. All prizes are also subject to the terms and conditions accompanying them (if any).
4.4	Kreta Ayer – Kim Seng CCC reserves the right, at its discretion, at any time, without notice or assigning any reason therefor, replace or substitute the Prize in the Draw with any other prize of equal or similar value selected by Kreta Ayer – Kim Seng CCC.
4.5	If Kreta Ayer – Kim Seng CCC subsequently discovers that the individual is in fact not eligible to participate in the Draw, Kreta Ayer – Kim Seng CCC may at its discretion forfeit the Prize(s) (or reclaim it /them if already awarded) and award or dispose of it/them in such manner and to such person/persons as Kreta Ayer – Kim Seng CCC deems fit. No winner shall be entitled to any payment or compensation from Kreta Ayer – Kim Seng CCC should any prize be forfeited/reclaimed.
4.6	Kreta Ayer – Kim Seng CCC shall not be liable to any participant or any other persons for any loss or damage arising in connection with the Draw, including without limitation, any error in computing any chances, any breakdown or malfunctions in any computer system or equipment. Without prejudice to the generality of the foregoing, Kreta Ayer – Kim Seng CCC assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and/or postage due mail.
4.7	The decision of Kreta Ayer – Kim Seng CCC on all matters relating to the Draw shall be final and binding on all participants and any other persons, including, without limitation, any decision to cancel or suspend the Draw. No correspondence(s) will be entertained.
4.8	In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Draw, these terms and conditions shall prevail.
4.9	Kreta Ayer – Kim Seng CCC may at any time at its sole and absolute discretion, without notice or assigning any reason therefor, terminate this Draw, delete, vary, supplement, amend or modify any one or more of these terms and conditions in such manner as Kreta Ayer – Kim Seng CCC shall think fit, including without limitation, the eligibility of any customer, the bases and methods of identification of winners and any dates in connection with the Draw, the Draw period, number of Draws and Draw Date. Kreta Ayer – Kim Seng CCC shall not, to the extent permitted by law, be liable to for any claims, costs, expenses, loss or damage suffered by any person as a result of the aforementioned matters.
4.10	These terms and conditions shall be governed by the laws of Singapore and the participants in the Draw irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.
4.11	A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce of these terms and conditions.
